Terms of Service

1. Introduction to the Terms

 

These Terms of Service ("Terms") apply to all contracts between ORA Medical ("Seller") and the buyer ("Buyer") of ORA Medical products. By entering into any contract with ORA Medical, the Buyer is considered to have accepted these Terms unless otherwise stated in a separate contract signed by an authorized ORA Medical representative.

2. Products Descriptions, Recommendations, and Limitations

 

Levity - Gait Trainer with Patented Body Weight Support Technology:

The Levity is designed to provide adjustable weight support for individuals with walking disabilities. Before purchasing the device, prospective buyers should consult with healthcare professionals and/or our team to ensure the Levity will meet their needs. All user manual information and instructions must be thoroughly read before using the Levity. The Seller reserves the right to make design changes to the Products periodically and does not guarantee that the Products supplied will be identical to any samples or as depicted in sales literature.

 

ORA Connect - Remote Monitoring Platform:

Currently in the R&D stage, ORA Connect is not yet available for public use and is intended only for research settings. Further information will be provided closer to its market release.

ORA Medical strives for accuracy in product descriptions and recommendations, the ultimate responsibility lies with the buyer to ensure the product meets their needs.

 

3. Price, Reservation, and Payment

 

Prices listed online are valid at the time of purchase but are subject to future changes without notice. Buyers are encouraged to confirm prices by signing an agreement with local distributors. In Canada, placing a Levity Reservation Deposit fixes the price to the rate on the deposit date. All applicable taxes and charges will be added to the purchase price as necessary.

 

A refundable deposit of 500 CAD is required to reserve Levity in Canada, which will be deducted from the Purchase Price.

 

The Buyer must pay all invoiced amounts before shipment. For scheduled payments, the initial payment is due prior to shipping.

4. Delivery, Inspection, Title, and Risk of Loss

 

Equipment will be delivered within a reasonable time after payment receipt. The Seller is not liable for delivery delays. The Buyer is responsible for inspecting the Equipment within five days of delivery and reporting any damages immediately.

 

Title and risk of loss pass to the Buyer upon delivery, provided the inspection does not show damage during transit. Until then, the Buyer agrees to use the Equipment responsibly, follow all instructions, and not encumber or transfer the Equipment in any way.

The Buyer is responsible for customs duties, taxes, and import fees if applicable.

5. Liability

 

We always strive to provide the best service, but there are things we can't guarantee. ORA Medical is not responsible for any indirect losses (like lost profits) or damages that happen because of our services/solutions or if you can't use them. The Buyer is responsible for personal injury or damage to property resulting from the use of the product outside of the Seller's General warnings, Intended use,  Indication for use and Technical information (refer to user manual).

 

6. Warranties

​

The Seller warrants that the Equipment will materially conform to the User Manual's specifications for one year from the delivery date. Provided all instructions have been followed, and no modifications have been made, any failing component will be repaired or replaced. After the warranty expires, repairs and replacements will be charged to the Buyer. Any modifications or repairs made by unauthorized personnel will void the warranty.

7. Trials, Returns, and Cancelled Orders

 

Buyers in Canada may conduct a two-week Trial with Levity if a 500 CAD deposit is made.

If the Trial is not successful, the Reservation Deposit will be kept to cover shipping and administrative costs.

 

What happens if you return the device within 14 days:

 

The equipment must be in original packaging and resalable condition.

The Seller will provide information on how to ship back the Levity to the distributor.

Any damages will be charged to the Buyer.

Orders can be cancelled before shipment with a full refund of any payments made.

If an order is cancelled with a scheduled payment Agreement, the next unpaid payment will be required to successfully cancel and return the Levity.

8. Modifications to Terms

​

ORA Medical reserves the right to modify these Terms and the Privacy Policy at any time without prior notice. Amendments will be effective upon posting on the website. 

 

9. Governing Law and Jurisdiction

​

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any disputes will be exclusively resolved in the courts of Montreal, Quebec. The United Nations Convention on Contracts for the International Sale of Goods is not applicable.
